We respect your concerns about privacy. This Privacy Policy (the “Policy”) provides information on how we (hereinafter referred to as “The Agoge,” “us,” and “our”) collect, process, and share personally identifiable information (also referred to as personal data, and referred to as “Personal Information” in this Policy) of individuals who are external to The Agoge, including but not limited to our Members, other users of and participants in our Services or any portion thereof (including without limitation our Sites and our Events) sponsors, partners, and service providers and their respective individual representatives, as applicable (referred to in this Policy as “you” or “your”). Personal Information generally includes any information about you – an individual, natural person.

 This Policy is incorporated in its entirety into our Terms of Service (the “Terms”). All capitalized terms not defined in this Policy shall have the meanings set forth in the Terms.

 1. What Personal Information will we collect from you? 

We collect and process Personal Information only for lawful reasons, such as when the processing is necessary to perform a contract (for example, to provide Services to our Members), our legitimate business interests, such as improving, personalizing, marketing, and developing the Services and promoting safety and security, or, where required, obtaining your consent.

Personal Information can be collected in a variety of ways, including through our interactions with you and through our Services. The Personal Information we collect depends on the context of your interactions with us and the choices you make, including your privacy settings and the Services and features you use. 

1.1 We collect Personal Information from you in the following ways.

1.1.1. Applications, Forms, and Profile Data: If you apply for Membership in one of our Communities or submit a form seeking more information about becoming a Member, you provide all of the Personal Information requested in the application or form, including but not limited to your name, gender, email, phone, birthday, address, employment information, and other information about your professional interests, goals, background, and experience.

1.1.2.Payment Data: If you are accepted for Membership, we will collect Billing Information in connection with your payment of your Membership Fees. Please note that we do not store your Billing Information, but the third-party payment processors we engage may retain your Billing Information in accordance with their own privacy policies and terms.

1.1.3. Inquiries, Discussions, and Other Data: You may interact with us, other Members or other users of the Services through our Sites, including through any interactive feature, online contact form, email, or any other communication mechanism. When using these channels, you typically provide your name, profile picture, email, phone, employment information, professional background, and any other information you choose to provide at your option.

1.1.4. Event Audio and Video: We may record audio and/or video of our Members, sponsors, panelists, and other participants of any of our Events for marketing purposes and also so Members and others who were unable to attend the event live may watch or listen to it at a later date. We also may request that our Members provide testimonials for our marketing purposes.

1.1.5. No Sensitive Information: Please do not provide any highly sensitive Personal Information to us – such as social security numbers, health or medical information, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or data concerning a person’s sex life or sexual orientation. We do not intentionally process highly sensitive Personal Information and reserve the right to reject or delete it.

1.2. We collect Personal Information from third parties in the following ways. 

We may collect Personal Information from third parties such as public websites or social networks, such as LinkedIn. This Personal Information may include names, contact information, email, professional or employment information, and other information which is publicly available.

We may use information collected from third parties for our own promotional or marketing purposes, such as sending prospective Members emails about our Services or sending information about our Members to potential employers.

We may purchase third-party marketing data and add it to our existing user database to better target our advertising and provide pertinent offers we think our users would be interested in. We use this information to enhance or overlay the ‘profile’ of individual users. This aggregate marketing data is therefore tied to the users’ Personal Information.

1.3. We collect some information automatically. 

If you visit our Sites without logging in and do nothing more than browse, read pages, or download information, we will not collect or store any Personal Information from you or about you. However, we may collect other data from you that is not Personal Information and does not reveal your specific identity or does not relate to an identifiable individual. When Members log in, the pages they visit and content they download may be collected to improve our Sites and share with partners. By utilizing our Services, you consent to the use of cookie or other tracking technologies to serve you retargeted advertising. Data collected may be shared with a third-party vendor for cross device linking and advertising purposes. We may collect this other data in a variety of ways, including: 
1.3.1. Through your browser or device: Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, date, and Internet browser type and version. We use this information to ensure that our website functions properly.

1.3.2. Aggregate Information: Aggregated demographic information may be shared with our partners and advertisers but is not linked to any Personal Information. We may collect general, non-personal, statistical information about the users of our website and our Services to determine information regarding the use of our website and general information about our customers. We may also group this information to provide general aggregated data. The aggregated data will not personally identify any customers or visitors to our website.

1.3.3. Using pixel tags and other similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used to, among other things, track the actions of website users and email recipients, market our Services to you, measure the success of our marketing campaigns and compile statistics about our website’s usage and response rates.

1.3.4. Analytics: We use third-party analytics providers such as Google Analytics on our website. Google Analytics uses cookies and similar technologies to collect and analyze information about your use of the Services and report on activities and trends. Google Analytics may also collect information regarding the use of other websites, apps and online resources. 1.3.5. IP Address: Your “IP Address” is a number that is automatically assigned to your computer by your Internet Service Provider. An IP Address may be identified and logged automatically in our server log files whenever a user accesses our website, along with the time of the visit and the pages visited. We use IP Addresses for purposes such as calculating usage levels, diagnosing server problems, and administering our website. We may also derive your approximate location from your IP Address.

1.3.6. Cookies. “Cookies” are pieces of information stored on the computer or mobile device that you are using. Cookies allow us to collect information such as browser type, time spent on our website, pages visited, registrations, submissions, demographics, information requests, language preferences, and other traffic data. We use the information for security purposes, to recognize your device, to facilitate navigation, to display information more effectively, and to improve your experience. We also gather statistical information about the use of our website to enhance its functionality, understand how it is used and assist us with resolving questions about it. We may also use cookies and other technologies in online advertising campaigns to track responses to our ads. If you do not want information collected through the use of cookies, most browsers allow you to automatically decline cookies, or be given the choice of declining or accepting a particular cookie (or cookies) from a particular site. If, however, you do not accept cookies, you may experience some inconvenience in your use of our website.

Cookies cannot spread viruses or harm your computer. With respect to how long a cookie stays on your computer or mobile device, some cookies are session cookies that expire once you close your browser while others are persistent cookies which stay on your device until you delete them or they expire.

 1.3.6.1. Strictly Necessary Cookies. These cookies are necessary for our website to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. You can set your browser to block or alert you about these cookies, but some parts of our websites will not then work. These cookies do not store any Personal Information.

1.3.6.2. Performance Cookies. These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our website. They help us to know which pages are the most and least popular and see how visitors move around the site. All information these cookies collect is aggregated and therefore anonymous. The data stored by these cookies never shows personal details from which your individual identity can be established. If you do not allow these cookies we will not know when you have visited our website and will not be able to monitor its performance. The data stored by these cookies never shows personal details from which your individual identity can be established. Other similar technology we may use includes web beacons that are used on some of our website pages and in emails we send. They allow us to count users who visited these pages. Web beacons collect limited information including a cookie number, time and date of a page view, and a description of the page on which the web beacon resides. We may also carry web beacons placed by third-party advertisers. We may also use web beacons or similar technology to learn whether or not emails sent to you have been opened. Web beacons are only used to track the effectiveness of a particular marketing campaign. Web beacons do not store any Personal Information.

1.3.6.3. Advertising and Social Cookies. These cookies may be set through our website by our advertising partners. These cookies collect Personal Information about your browsing habits in order to make advertising more relevant to you and your interests. Personal Information and data stored by these cookies are based on uniquely identifying your browser and internet device. We also use social media cookies to allow you to share our content on social networking sites like Facebook, Twitter, LinkedIn, Instagram, TikTok, and YouTube. Disabling these cookies may result in seeing advertising that is not as relevant to you or you not being able to link effectively with social networks and/or not allowing you to share content on social media.

 2. What will we do with your Personal Information? 

We will only process your Personal Information if we have a lawful basis for doing so. Lawful bases for processing include express or implied consent, contractual necessity and our “legitimate interests” or the legitimate interest of others, as further described below. In some cases, we process Personal Information based on the consent you expressly grant to us at the time we collect such Personal Information. We collect and process Personal Information as a matter of contractual necessity so that we can provide our Services in accordance with our Terms.

2.1. Our Use of Your Information. Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use Personal Information to: 

  • Comply with legal, reporting, and regulatory requirements;
  • Compile anonymous statistical data and analysis for use internally or with third parties;
  • Determine whether to grant you Membership;
  • Create and manage your account;
  • Deliver targeted advertising, newsletters, and other information regarding promotions and our Sites to you;
  • Email you regarding your account or order;
  • Fulfill and manage purchases, orders, payments, and other transactions related to our Services;
  • Increase the efficiency and operation of our Services;
  • Monitor and analyze usage and trends to improve your experience with our website;
  • Notify you of updates to our Services;
  • Offer new Services, services, and/or recommendations to you;
  • Perform other business activities, as needed;
  • Prevent fraudulent transactions, monitor against theft, and protect against criminal activity;
  • Process payments and refunds;
  • Request feedback and contact you about your use of our Services;
  • Resolve disputes and troubleshoot problems;
  • Respond to Service and customer service requests; 
  • Send you a newsletter; and
  • Send you physical mail.

2.2. Sales of Personal Information. We may sell your Personal Information to Event Sponsors and/or other third parties. If you do not want us to sell your data, do not visit the Sites.

2.3. Disclosures of Personal Information.

2.3.1. In order to properly and efficiently provide you with our Services, we may share the following types of Personal Information to a limited group of trusted third parties:

  • Identifiers such as your name and email address;
  • Internet or other electronic activity information such as network activity information or information obtained from your device like browsing history on our website, IP address, search history on our website, your interaction with an advertisement, installed plug-ins, and javascript objects on your device;
  • Credit, debit, or payment card information if used, such as for billing; and/or
  • Geolocation data and/or address.

    2.3.2. The above Personal Information may be disclosed to the following limited group of third parties:

    2.3.2.1. Our Agents. We employ and contract with people and other entities that perform certain tasks on our behalf and who are under our control (our “Agents”), such as our attorneys, accountants, auditors, shippers, IT service providers, customer resource management service providers, chat and blog tool providers, analytics partners, and payment processors. We may need to share Personal Information with our Agents in order to provide Services to you. For example, if you purchase any of our Services, we will need to share your name and credit card information with our credit card processing Agent to complete the transaction. Unless we tell you differently, our Agents do not have any right to use Personal Information or other information we share with them beyond what is necessary to assist us. You hereby consent to our sharing of Personal Information with our Agents.

    2.3.2.2. Government agencies. We may disclose Personal Information to regulatory authorities, government authorities or courts to comply with applicable laws, the service of legal process, or if we reasonably believe that such action is necessary to (a) comply with the law requiring such disclosure; (b) protect the rights or property of The Agoge LLC or its affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of the users or the public.

    2.3.2.3. Business transfers. We may choose to buy or sell assets. In these types of transactions, Personal Information is typically one of the transferred business assets. Moreover, if we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, Personal Information would be one of the assets that may be transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your Personal Information as set forth in this Policy.

    2.3.2.4. Our employees, partners, affiliates, and subsidiaries. With their consent, when a user signs up for particular Services, we may share customer data with our subsidiaries for the business purpose of allowing them to offer additional business offerings that would address a customer’s business needs. These third parties are not allowed to use Personal Information except for the purpose of providing these services.

    2.3.2.5. Event Sponsors. If you attend one of our sponsored events, we may share or sell your name, email, job information, and LinkedIn profile with the sponsor for their own marketing and business purposes. When required under applicable law, we will obtain your consent before sharing your data with our sponsors for their own purposes. 

3. How do you respond to Do Not Track signals?

Some web browsers may transmit “do-not-track” (“DNT”) signals to mobile applications with which the user communicates. We currently do not change our tracking practices in response to DNT settings in your web browser.

Our third party partners, such as web analytics companies and third party ad networks, may collect information about you and your online activities over time and across our Services and other online properties. These third parties may not change their tracking practices in response to DNT settings in your web browser and we do not obligate these parties to honor DNT settings. We utilize Google Analytics for our web analytics and you can opt out of your usage data being included in our Google Analytics reports by visiting https://tools.google.com/dlpage/gaoptout.

4. How long will you keep my Personal Information?

We will only retain the information associated with your account as long as it is needed to comply with our legal obligations, resolve disputes, prevent fraud and abuse, and enforce our agreements. We store very limited financial information, such as your credit card information, only for as long as needed to ensure that you receive the Services you request. For example, if you purchase a Membership on a subscription basis, we will keep your payment information on file until you cancel your subscription. Otherwise, all financial information is stored by our payment processor, Stripe, and you are encouraged to review their privacy policy and contact them directly for responses to your questions. 

5. What’s not covered in this Policy? 

This Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any site or service to which our website links. Our services sometimes link to goods and services from other companies. Those other companies have their own privacy and cookies policies, so remember that the information you give them will follow their rules and not ours. Additionally, we may use social buttons provided by social media companies. Your use of these third-party sites is entirely optional. We are not responsible for the privacy policies and/or practices of these third-party sites, and you are responsible for reading and understanding those third-party site’s privacy policies.

6. Is my information secure with you?

We use reasonable organizational, technical, and administrative measures designed to protect Personal Information and other data within our organization. When users submit sensitive information via the website, their information is protected both online and off-line. When our registration/order form asks users to enter sensitive information (such as a credit card number), that information is encrypted and is protected with the best encryption software in the industry - SSL. While on a secure page, such as our order form, the lock icon on the bottom of Web browsers becomes locked, as opposed to unlocked, or open, when users are just ‘surfing’. To learn more about SSL, follow this link. While we use SSL encryption to protect sensitive information online, we also protect user-information off-line. All of our users’ information, not just the Personal Information, is restricted in our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to Personal Information. Furthermore, all employees are kept up to date on our security and privacy practices.

Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure or have any questions about our security, please immediately notify us in accordance with the “CONTACT US” in Section 12, below. 

7. Can I change the way I receive information from you?

 

We may contact you, by email or other means. We may also use technology to alert us via a confirmation email when you open an email from us. You can modify your email notification preferences by clicking the appropriate link included in the footer of email notifications. If you do not want to receive email from us, please opt out of receiving emails at the bottom of any of our emails. Otherwise, you may unsubscribe by doing either of the following:

8. Are your Services intended for minors?

Our Services are intended for adults 18 years of age or older. We do not knowingly collect Personal Information from children under 18. If we learn that we have collected any Personal Information from a child under 18, we will take reasonable steps to delete such information. Parents or guardians who believe that their child has submitted Personal Information to us and would like to have it deleted should contact us at [email protected] 

9. What’s different for residents of Nevada? 

We comply with SB 220. Nevada residents may send opt out requests or email questions regarding our practices relating to Personal Information to [email protected] or call (413) 284-2485.


10. What’s different for residents of California? 

If you are a California resident, you have the right, subject to certain exceptions defined in the California Consumer Privacy Act (“CCPA”) and other applicable laws and regulations, to request that we disclose certain information to you about our collection and use of your Personal Information over the past twelve (12) months. You will not receive discriminatory treatment for exercising your rights under the CCPA. If you would like to exercise your rights to make an information access request or a deletion request, please click the applicable links below. In order to verify your request, you will need to provide your legal first and last name, email address you use to correspond with us, your relationship with us, and the state you currently reside in. After you submit the form, you will need to verify your email by clicking on a “Confirm Email” button in the email we will send you.

If you authorize an agent to make an access or deletion request on your behalf, please have the authorized agent call the toll-free number at 413-284-2485 because we will need to verify the authorization before processing the request. The authorized agent will need to submit documentation evidencing your authorization of this agent to make the request and the authorized agent will need to verify their identity with us.

11. What’s different for residents outside of the United States? 

Our website is controlled and operated by us from the State of Washington in the United States and is not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. If you are visiting our website from outside the U.S., you agree to any processing of any Personal Information you provide us according to this Policy.

The Personal Information we collect within your country may be transferred outside of your country to The Agoge or its third-party contractors or service providers (mentioned above) for the purposes described in this Policy. As required by law, we rely on appropriate safeguards or applicable derogations, or obtain your consent, when we transfer Personal Information across international borders.

 Depending on your location, you may have certain legal rights regarding your Personal Information, including:

  • You may request access to your Personal Information and obtain information about our processing of your Personal Information, with whom we share your Personal Information, and your rights.
  • You may request that we restrict our processing of your Personal Information.
  • You may object to our processing of your Personal Information.
  • If we process Personal Information based on your consent, you may withdraw your consent.
  • You may correct Personal Information that is inaccurate or incomplete.
  • You may request that we delete your Personal Information or provide a copy of it to you.
  • We may request proof of your identity before acting upon any request. If you live in the EEA, UK, or Switzerland, and you are unsatisfied with our response, you have the right to lodge a complaint regarding your Personal Information with an applicable supervisory authority.

12. How will I find out about changes to this Policy?

The “Last Updated” legend at the top indicates when this Policy was last changed. This Policy may be amended, modified, updated or terminated at any time by The Agoge, provided that we notify you in advance of any material amendment, modification or update by posting an amended version of the Policy through the Sites (and the date of such posting shall be deemed the date of notification) or by notifying you of such change(s) in accordance with the notification provision included in the Terms. It is your responsibility to periodically review this Privacy Policy, and you are on notice of and bound by any changes when you continue to use our Services or engage with us after you have been notified of such changes in accordance with the Terms.
